By downloading or using RailRadar (the "Service"), you agree to these Terms. If you don't agree, don't use the Service.

1) What RailRadar is (and isn't)

  • Community-sourced status of railroad crossings; accuracy can vary.
  • Informational only. Not for navigation or emergencies.
  • Don't use while driving. Obey traffic laws.

2) Eligibility & Accounts

You must be 13+ (or your region's digital age of consent). Under 18: use only with parent/guardian consent.

Keep your login secure; you're responsible for activity on your account.

We may suspend/terminate or refuse accounts to protect users or the Service.

3) Your Content

You may submit reports, notes, reactions, photos/videos, usernames ("User Content").

You own it. You grant RailRadar a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify for formatting, display, and distribute your User Content in the Service and in aggregate/anonymized outputs (e.g., charts, timelines, marketing screenshots).

Don't upload content you don't have rights to or that violates law or others' rights.

4) Acceptable Use

Don't:

  • Post knowingly false reports, spam, or manipulate statuses (e.g., mass false blockages).
  • Harass, impersonate, dox, or upload illegal content.
  • Reverse engineer, scrape at scale, bypass rate limits/security, or overload the Service.
  • Use RailRadar for emergency response or other safety-critical operations.

We may remove content, rate-limit, or restrict features to protect accuracy and safety.

5) Towns, Crossings & Sharing

Town identity may use third-party place data (e.g., Google Place IDs). Boundaries may be imperfect.

Crossing statuses are shared with other users in the same town.

We may rename/merge duplicates or deactivate invalid crossings.

6) Location, Notifications, Devices

Location (optional, foreground only). Used to improve town selection and de-dupe reports. No background location required.

Notifications (optional). Alerts when a crossing changes; configurable in Settings/OS (with Quiet Hours/Snooze).

Your carrier/platform may charge data or messaging fees.

7) Third-Party Services

We rely on services like Google Places, Apple/Google Maps deep links, crash analytics, and push providers. Their terms apply. We're not responsible for third-party sites/services.

8) Social Signals

Reactions (👍/👎) are social only and don't control official status updates.

9) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." No warranties (express or implied) including accuracy, reliability, merchantability, fitness, or non-infringement. Not a substitute for official rail/road notices or emergency services.

10) Limitation of Liability

To the fullest extent permitted by law, RailRadar and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or use. Our total liability for any 12-month period is limited to the greater of US$50 or the amount you paid us in that period.

11) Indemnity

You'll defend, indemnify, and hold harmless RailRadar from claims and costs (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your breach of these Terms/law.

12) App Store/Play Terms

Apple: These Terms are with RailRadar, not Apple. Apple isn't responsible for the app or content and has no support obligation. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.

Google Play: Google isn't responsible for support or claims. You must follow Play policies.

13) Changes to the Service

We may change, suspend, or discontinue features at any time. We'll try to notify you of material changes.

14) Changes to Terms

We may update these Terms. Material changes will be noticed in-app or by email. Continued use = acceptance.

15) Termination

You may stop using the Service anytime. We may suspend/terminate for violations, harm, or operational/security reasons. Upon termination, certain licenses/survival clauses continue (e.g., Sections 3, 9–11, 19).

16) Deletion & Data Requests

Delete your account in-app (Settings → Privacy & Data). Request a copy of your data in-app. See the Privacy Policy for details.

17) IP & Trademarks

RailRadar owns the Service and related IP (excluding your User Content). Don't use our marks without permission.

18) Feedback

If you share ideas, you grant us a free, perpetual, irrevocable license to use them without restriction or payment.

19) Governing Law; Disputes

  • Law: Delaware, USA (conflicts rules excluded).
  • Venue: State/federal courts in New Castle County, Delaware.
  • (Optional) Arbitration & Class Waiver: Insert your preferred clause (AAA/JAMS) with a 30-day email opt-out to legal@railradar.online, or remove if not using arbitration.

20) Export/Sanctions

Comply with applicable export/import/sanctions laws. Don't use the Service if you're on a restricted list or in a restricted region.

21) Entire Agreement

These Terms plus referenced policies (including the Privacy Policy) are the entire agreement between you and RailRadar.
